Minutes of the Meeting of the Rootstown Township Zoning Board of Appeals
July 19, 2011

The regular meeting of the ROOTSTOWN ZONING BOARD OF APPEALS was held on Tuesday, July 19, 2011 at 7:00 P.M. at the Rootstown Town Hall.

Mr. Cutright called the meeting order. Mr. Cutright introduced the Board members and explained the evenings' procedures.

The first item on the agenda was an application for a variance for an accessory building to be 5 feet off the property line from Section 310.0f9, B, 1, C for property located at 3080 Clearview Road in an R-2 District submitted by:

Mr. Cutright swore in Christian and Michele Cirino, 3080 Road, Ravenna, Ohio. Mrs. Cirino stated they wanted to put an accessory building on the back of the property for storing lawn equipment. This would give the best use of the backyard.

Mr. Cirino said he would be removing the small shed and replacing it with an accessory building. The shed is tacky for the neighborhood. He needed storage for lawn equipment, jet skies and a hobby car. It would be strictly storage. The garage/accessory building would be 20 x 20 and would be located closer to the property line. This would give them a good size building for storage and also a good size backyard. He was not planning on putting in a driveway; this would be strictly storage. There could be a driveway put in the future.

Ms. Milnes asked about the location of the front of the garage. Mr. Cirino said the front of the garage would be facing the street but it won�t look like a garage. It would be about half way behind the sunroom.

Mr. Ball asked about the current driveway. Mr. Cirino showed the Board the location of the driveway. Mr. Cirino said there could be a driveway back to the building if necessary.

Mrs. Saillant asked what was directly behind the structure. Mr. Cirino said there was a corn field (all farm land). Mrs. Saillant asked what was left on the drawing. Mr. Cirino said there was the neighbor�s 10 x 10 shed which was about 3 or 4 feet off the property line. Mrs. Cirino said the neighbors built an addition to their house right before they moved in. They have lived there about 11 years. The neighbors got a variance for that and it is about 2 to 3 feet off the property line. Mrs. Saillant asked about the size of the accessory building. Mr. Cirino said it was 24 x 24 but he was downsizing it to 20 x 20.

Mr. Cutright said the plans show the accessory building to be 18 x 20. Mr. Cutright asked what the neighbors name was. Mr. Cirino said it was Parks. Mr. Cutright asked if the new building was going to be portable. Mr. Cirino said there would be a foundation and it would be permanent. Mr. Cutright asked if there was any way they could bring the building closer to the house. Mr. Cirino said he didn�t want to give up the 5 feet from the property line on the neighbor�s side.

Mr. Mahood asked if the fence was on the property line. Mr. Cirino said he thought it was.

Mr. Cutright said he would move the building closer to the house and give a few feet closer to the back property line.

A discussion followed on the location of the new building. There were suggestions for putting it closer to the house and closer to the back property line. Mrs. Cirino did not want to be looking out of her sunroom at a building. It was also suggested that the size of the building could be changed.

Mr. Cirino stated that before he even did the work on the garage; he would have the property surveyed.

Mr. Cutright asked the audience if there were any questions, comments, or concerns.

Resolution ZBA 2011-007. Mrs. Saillant made a motion to grant the request for an accessory building to be located 3 feet from the back (south) from the property line, 7 feet from the side (east) from the property line and 17 feet from the corner of the house from Section 3310.09 B, 1, C. Ms. Milnes seconded it. A vote was taken as follows: Milnes - Yes Ball - Yes Saillant - Yes Cutright - No. The motion carried by a vote of 3/1.

Resolution ZBA 2010-008. Mr. Ball made a motion to accept the minutes of August 17, 2010 meeting with the following correction: last page, first paragraph add "Storm" after County. Mrs. Milnes seconded it. The motion carried unanimously (4/0).

Mr. Cutright adjourned the meeting.
