Minutes of the Meeting of the Rootstown Township Zoning Board of Appeals
June 15, 2010

The regular meeting of the ROOTSTOWN ZONING BOARD OF APPEALS was held on Tuesday, June 15, 2010 at 7:00 P.M. at the Rootstown Town Hall.

Mr. Boring called the meeting order. Mr. Boring introduced the Board members and explained the evenings' procedures.

The first item on the agenda was an application for a variance for an accessory building to be located in front of the house due to backyard conditions (hill, septic, and wetness) from Section 310.09, B, 1 for property located at 3438 Kline Road (Parcel #32-026-00-00-011-000) in a R-1 District submitted by:

Mr. Boring swore in Paul Basel, 3438 Kline Road, Rootstown, Ohio. Mr. Basel said he would like to put up a garage 24 x 32 in front of the house because the backyard has the leech bed. The house is located on top of a hill. That was the only flat place in the yard.

Mr. Manion asked if there was a garage in the existing house now. Mr. Basel said there was an attached garage. Mr. Manion asked what the new building would be used for. Mr. Basel said it would be used for tractors and more cars. Mr. Manion asked about the property that was adjacent to where the building would be and how close to the property line. Mr. Basel said it was about 15 feet. R. Manion asked what was on the lot next to where the building would go. Mr. Basel said there was a residence there.

Mr. Ball had no questions.

Mr. Cutright stated that Mr. Basel's house was somewhat inline with the brick house on the hill. Mr. Basel said that was right. Mr. Cutright asked about putting the building directly across from the garage. Mr. Basel said that was where a power transformer was.

Mr. Boring asked what the garage was going to look like. Mr. Basel said they would try to make look like the house as much as possible. Mr. Boring asked if the house and garage was visible from the road. Mr. Basel said the house was not visible since they were on a fairly wooded lot. You might see it in the wintertime but not in the summer. Mr. Boring asked if the neighbors could see where the building would be located. Mr. Basel said the people on top of the hill could not but the people on the north side below him could. Mr. Boring asked if there was anywhere else the building could be put. Mr. Basel said he could put it on the other side but it would still be in front of the house. Mr. Boring stated that it looked like the house was about 700 feet off the road. Mr. Basel said that sounded about right.

Mr. Mahood asked how large the property was. Mr. Basel said it was 3.9 acres.

Mr. Boring asked if the neighbors closest to the garage and could they see it. Mr. / Basel said they could see it. In fact their garage is in the same area. Mr. Boring stated the neighbor's garage was in front as well.

Mr. Boring asked the audience if there were any questions, comments, or concerns. There were none.

Resolution ZBA 2010-008. Mr. Manion made a motion to grant the variance request from Section 310.09, B, 1. Mr. Boring seconded it. A vote was taken as follows: Ball - Yes Cutright - No Manion - Yes Boring - Yes. The motion carried by a vote of 3/1.

Next on the agenda was an application for a variance for an addition to the house from Section 310.04 D for property located at 2694 Sandy Lake Road (Sandy Lake Association) submitted by:

Mr. Boring stated that there was approval from the Sandy Lake Association.

Mr. Boring swore in Owen Millsaps, 2694 Sandy Lake Road, Ravenna and Rich Reiheld, 20010 Berger Ave. Stow. Mr. Millsaps said his daughter and son-in-law and their three children would be moving in and he wanted to add two bedrooms onto the house. There would be another bedroom/bath on the second floor and on the third a master suite. They would not be getting any closer on the south, east or westside. On the north side, they would come out 4 feet with a covered entry.

Mr. Boring referred to the plan and where the entry would be. Mr. Basel said the entry would be out front with pillars.

Mr. Mahood said Mr. Basel would not be extending the house with the addition. It was just filling in the gape and going up.

Mr. Manion had no questions.

Mr. Ball had no questions.

Mr. Cutright asked who put the stamp/ Seal of approval on the map. It was Becky Brittain, secretary of the Association. Mr. Boring mentioned the agreement between the Sandy Lake Association and the Rootstown Township.

Mr. Boring swore in Becky Brittain, 2658 Sandy Lake Road. Ms. Brittain said there was a correction; it was not Sandy Lake Association but Sandy Lake Inc.

Mr. Boring asked the audience if there were any questions, comments, or concerns. There were none.

Resolution ZBA 2010-009. Mr. Manion made a motion to grant the variance request from Section 310.04, D recognizing that this is in the Sandy Lake Inc. one of three lake area developments in which we deal with all of which have a copy on file recognizing that the property owner is of one person none of these properties have a true lot of record therefore it requires the downers approval before coming to the Zoning Board of Appeals. Mr. Cutright seconded it. A vote was taken as follows: Cutright - Yes Manion - Yes Ball - Yes Boring - Yes. The motion carried unanimously (4/0).

Resolution ZBA 2010-010. Mr. Cutright made a motion to adjourn the meeting. Mr. Manion seconded it.

Mr. Boring adjourned the meeting.
